1. Acceptance of Terms
By accessing, browsing, or using Comment Miner (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must immediately discontinue use of the Service. We reserve the right to deny access to anyone for any reason at any time.
2. Service Description
Comment Miner is a Software-as-a-Service (SaaS) platform that analyzes YouTube video comments using artificial intelligence. The Service provides insights, sentiment analysis, and recommendations based on viewer feedback. The Service is provided for informational purposes only and should not be relied upon as the sole basis for any business, content, or marketing decisions.
3. Eligibility and User Accounts
You must be at least 18 years old or the age of legal majority in your jurisdiction to use this Service. By creating an account, you represent that you meet this requirement. You are solely responsible for maintaining the confidentiality of your account credentials, for all activities that occur under your account, and for any consequences resulting from unauthorized access due to your failure to safeguard your credentials.
4. Subscription Plans, Credits, and Pricing
Our Service operates on a credit-based subscription model. Each analysis consumes one credit. Credits are allocated monthly based on your subscription plan and DO NOT roll over to the next billing period—unused credits expire at the end of each billing cycle. WE RESERVE THE RIGHT TO CHANGE PRICING, CREDIT ALLOCATIONS, AND SUBSCRIPTION PLANS AT ANY TIME WITH OR WITHOUT PRIOR NOTICE. Price changes will apply to new billing cycles. Continued use of the Service after a price change constitutes acceptance of the new pricing.
5. Payment Terms and Refunds
Payments are processed securely through third-party payment processors (currently Lemon Squeezy). Subscription fees are billed monthly in advance. You may cancel your subscription at any time through your account settings. NO REFUNDS will be provided for unused credits, partial billing periods, or any other reason. All sales are final. We are not responsible for any fees, charges, or taxes imposed by your payment provider or government.
6. No Guarantees of Results or Accuracy
THE SERVICE IS PROVIDED FOR INFORMATIONAL AND ENTERTAINMENT PURPOSES ONLY. WE MAKE NO GUARANTEES, REPRESENTATIONS, OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR USEFULNESS OF ANY ANALYSIS, INSIGHTS, OR RECOMMENDATIONS PROVIDED BY THE SERVICE. Results may contain errors, inaccuracies, or misleading information. You acknowledge that any reliance on the Service's output is at your own risk.
7. AI-Generated Content Disclaimer
Analysis results are generated using artificial intelligence models (including but not limited to OpenAI's GPT models). AI systems can and do make mistakes, produce inaccurate or biased results, hallucinate information, or provide inappropriate content. AI-generated insights should NEVER be used as the sole basis for important decisions. WE ARE NOT RESPONSIBLE FOR ANY DECISIONS, ACTIONS, OR CONSEQUENCES RESULTING FROM YOUR USE OF OR RELIANCE ON AI-GENERATED CONTENT. You agree to independently verify any information before acting upon it.
8. YouTube API and Third-Party Services
Comment Miner uses the YouTube Data API to fetch video comments. By using our Service, you agree to comply with YouTube's Terms of Service and Google's Privacy Policy. We are not affiliated with, endorsed by, or sponsored by YouTube or Google. We do not guarantee the availability, accuracy, or completeness of data from YouTube. Changes to YouTube's API, policies, or service availability may affect our Service's functionality without notice.
9. Data Privacy and Security
We collect and process data in accordance with our Privacy Policy. We use Firebase for authentication and data storage. While we implement reasonable security measures, NO SYSTEM IS 100% SECURE. We cannot guarantee the security of your data and are not liable for any unauthorized access, data breaches, or data loss. We do not sell your personal data to third parties.
10. Usage Limits and Fair Use
Each analysis is limited to videos with a maximum of 5,000 comments. We reserve the right to impose, modify, or enforce usage limits, rate limits, or other restrictions at any time to ensure fair resource allocation and service stability. Excessive usage may result in temporary or permanent account restrictions.
11. Prohibited Use
You may NOT use Comment Miner: (a) for any illegal purposes; (b) to harass, defame, or harm others; (c) to scrape, collect, or resell data; (d) to circumvent usage limits or security measures; (e) to interfere with the Service's operation; (f) to violate any third-party rights; (g) to analyze content that violates YouTube's policies; or (h) in any way that could damage our reputation or business. We reserve the right to terminate accounts that violate these terms immediately and without refund.
12. Service Availability and Modifications
WE DO NOT GUARANTEE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE SERVICE. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. WE RESERVE THE RIGHT TO MODIFY, SUSPEND, OR DISCONTINUE THE SERVICE (OR ANY PART THEREOF) AT ANY TIME, WITH OR WITHOUT NOTICE, FOR ANY REASON. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
13. Intellectual Property
Comment Miner, its name, logo, design, features, and functionality are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission. The analysis results generated specifically for your videos are licensed to you for your personal or business use, but we retain all rights to the underlying technology and methodologies.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE EXPLICITLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. We do not warrant that the Service will meet your requirements or expectations.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
16. Indemnification
You agree to defend, indemnify, and hold harmless Comment Miner, its owners, operators, affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the Service, or your violation of any rights of a third party.
17. Beta Features and Experimental Services
From time to time, we may offer beta features or experimental services. These are provided "as is" without any warranty, may contain bugs or errors, and may be discontinued at any time. Your use of beta features is entirely at your own risk.
18. Changes to Terms
We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. Changes will be effective immediately upon posting. We may, but are not obligated to, notify users of significant changes. It is your responsibility to review these Terms periodically. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
19. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operator is located, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, and you waive any right to participate in class action lawsuits or class-wide arbitration.
20. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Comment Miner regarding the Service.
